Domain provides performance testing and optimization services through our online platform. Our services include but are not limited to consultation, analysis, testing, and implementation of performance improvements tailored to individual client needs.

To the maximum extent permitted by applicable law, Domain shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of or inability to access or use our services
  • Any conduct or content of any third party on the services
  • Any content obtained from the services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising from or related to our services shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that:

  • The services will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The services are free of viruses or other harmful components
  • The results of using the services will meet your requirements

12. Indemnification

You agree to defend, indemnify, and hold harmless Domain, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Use or your use of our services.

Our services may contain links to third-party websites or services that are not owned or controlled by Domain. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

14. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of these terms and, where appropriate, by additional means such as email notification. Your continued use of our services after any such changes constitutes your acceptance of the new Terms of Use.

15. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Use. Upon termination, your right to use the services will immediately cease.

You may terminate your account at any time by contacting us. All provisions of these Terms of Use that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Governing Law

These Terms of Use shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights.

17. Dispute Resolution

Any dispute arising from or relating to these Terms of Use or our services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, the dispute may be submitted to binding arbitration or litigation as permitted by applicable law.

18. Severability

If any provision of these Terms of Use is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.

These Terms of Use, together with our Privacy Policy and any other legal notices published by us on our services, constitute the entire agreement between you and Domain concerning our services and supersede all prior agreements and understandings regarding the same subject matter.
